Accurate Information
The DMCA requires that you swear to the facts in your notice of infringement under penalty of perjury. It is a federal crime to intentionally lie in a sworn declaration. (See U.S. Code, Title 18, Section 1621). Submitting false information could also result in civil liability—meaning that you could be sued for money damages.
Investigate
Filing a DMCA notice of infringement is a serious legal allegation. We ask that you conduct a thorough investigation and consult with an attorney before submitting a takedown request to ensure that the use isn’t actually permissible.

No Automated Bots
You should have a trained professional evaluate the facts of every takedown notice you send. If you are outsourcing your efforts to a third party, make sure you know how they operate and make sure they are not using automated aka A.I. bots to submit notices in bulk as well as use legal farms located overseas. The best way to ascertain this is to call the company directly. Reputable legal services have an answering service, customer service reps that speak clearly with proper language, and attorneys available to speak to. Notices sent by these types of entities are often invalid, unresearched, and aren’t looked at by a real attorney. We highly suggest using Google to vet the reputation of the legal company you are using and that you read the reviews from customers who have used the company.
Counter Notices
Any user affected by your takedown notice may submit a counter-notice. If they do, we will re-enable their content within 14 days unless you notify us that you have initiated a legal action seeking to restrain the user from engaging in infringing activity relating to the content on Daily Regimens web and mobile properties.
The Determination
Daily Regimens exercises little discretion in the process other than determining whether the notices meet the minimum requirements of the DMCA. It is up to the parties (and their lawyers) to evaluate the merit of their claims, bearing in mind that notices must be made under penalty of perjury.
How to Submit Your Notice and Counter Notice
The fastest way to get a response is to provide us the following information:
A physical or electronic signature (typing your full name will suffice);
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (the description from the copyright notice will suffice);
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district court in which Daily Regimens may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
